These Terms of Use ("Terms") govern your use of getcovest.com and any page, calculator, report or tool on it (the "Site"). The Site is operated by Covest LLC ("Covest," "we," "us"), a Colorado limited liability company and licensed Colorado real estate brokerage. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who can use the Site

The Site is meant for adults. You must be at least 18 years old to submit information through it.

2. Using the Site doesn't make us your broker

Browsing the Site, using a calculator, reading a market report, submitting a form or booking a call does not create a brokerage relationship between you and Covest, and does not make any Covest broker your agent or transaction-broker. Under Colorado law (C.R.S. § 12-10-401 et seq.), a brokerage relationship with a buyer, seller, landlord or tenant is established by a written agreement. Until we sign one with you, we don't represent you, and you shouldn't share anything with us you'd want kept confidential in a negotiation.

Before we talk about specific property, we'll give you the Colorado Real Estate Commission's "Definitions of Working Relationships" disclosure, which explains the different ways a broker can work with you.

3. Not tax, legal, financial or investment advice

Covest is a real estate brokerage. We are not your CPA, attorney, financial advisor or lender. Content on the Site, including the tax strategy page and its calculator, is general education. Tax outcomes such as cost segregation and bonus depreciation depend on your facts, the specific property, how you participate in it, and current law, all of which can change. Talk to your own CPA and attorney before you act on anything you read here.

4. Projections, estimates and calculators

Revenue projections, pro formas, tax estimates, market data and portfolio results on the Site are illustrations based on assumptions and historical data. They are not promises or guarantees of future performance. Short-term rental income is affected by regulation, licensing, seasonality, competition, management, financing and the economy. Past results on properties we or our clients have owned don't guarantee similar results for you. Verify any figure independently before relying on it.

Short-term rental rules vary by city and county in Colorado and change often. Whether a property can be licensed for short-term rental use is something you must confirm with the local jurisdiction before you buy.

5. Third-party companies and links

The Site links to companies Covest works with, such as AirSimplicity (property management) and Altimeter (revenue management software). These are separate companies. Their services are governed by their own agreements and terms, and Covest isn't responsible for their content, services or policies. If we refer you to any service provider, you're free to choose a different one.

6. Texts, calls and emails

When you submit your phone number or email through the Site, you agree that Covest may contact you by call, text or email about your inquiry and related services. Message and data rates may apply. Consent to marketing texts is not a condition of any purchase or service. You can opt out at any time by replying STOP to a text, using the unsubscribe link in an email, or emailing us.

7. Your information

Our Privacy Policy explains what we collect and how we use it, including your rights under the Colorado Privacy Act where it applies.

8. Our content

The Site's text, design, photos, graphics, calculators, data and logos belong to Covest or its licensors and are protected by copyright and trademark law. You may view and share pages for your personal, non-commercial use. You may not copy, scrape, resell or republish Site content, or use it to build a competing product, without our written permission.

9. Acceptable use

You agree not to:

  • Submit false information or someone else's information without permission
  • Use bots, scrapers or automated tools to access or collect data from the Site
  • Interfere with the Site's security or operation, or try to access areas you aren't authorized to use
  • Use the Site for anything unlawful, including any violation of fair housing laws

10. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, Covest disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We work to keep information current, but listings, market data, regulations and figures can be out of date or contain errors.

11. Limitation of liability

To the fullest extent permitted by law, Covest and its members, brokers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or investment losses, arising from your use of the Site or reliance on its content. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100).

This section applies only to your use of the Site. It doesn't limit any duty Covest owes you under a signed brokerage agreement or under Colorado real estate law, and nothing in these Terms waives any right you have that can't be waived under Colorado law, including the Colorado Consumer Protection Act.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold Covest harmless from claims and costs, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. If a dispute comes up, please contact us first and we'll try to resolve it informally. Any lawsuit related to the Site or these Terms must be brought in the state or federal courts located in Colorado, and you and Covest consent to the jurisdiction of those courts.

14. Licensing and fair housing

Covest LLC is a real estate brokerage licensed by the Colorado Division of Real Estate. Covest is committed to the Fair Housing Act and the Colorado Anti-Discrimination Act and supports equal housing opportunity for everyone.

15. Changes

We may update these Terms from time to time. The effective date at the top shows when they last changed. If you keep using the Site after a change, the updated Terms apply.

16. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Covest about the Site. Any brokerage, consulting or service agreement you sign with us governs that engagement.
